Terms of Service
These Terms of Service (“Terms”) govern your use of the Baggage Trace mobile application, website, and related services (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Baggage Trace helps users record suitcase details and photographs, associate baggage labels with journeys, retain passenger and tracking information, prepare missing-baggage details, and open relevant third-party tracking or recovery pages.
2. Eligibility
You must be legally capable of entering into these Terms. If you use the Service for another traveller, you confirm that you have their permission to store, use, and share their information. A parent or guardian must supervise use involving a child.
3. Your responsibilities
You are responsible for:
- Entering accurate passenger, flight, suitcase, baggage-tag, PIR, and contact information.
- Verifying any number detected from a photograph before relying on or submitting it.
- Reporting delayed, damaged, or missing baggage directly to the appropriate airline within its deadlines.
- Keeping your device and locally stored information secure.
- Sharing personal and baggage information only with appropriate recipients.
- Complying with airline, airport, insurance, customs, and applicable legal requirements.
4. No airline affiliation or guarantee
Baggage Trace is independent and is not endorsed by or affiliated with any airline, airline alliance, airport, baggage-recovery platform, or tracking provider unless expressly stated. Airline names and links identify third-party services. We do not control baggage operations, claim decisions, tracking results, website availability, response times, compensation, or recovery outcomes.
5. Third-party services and links
The Service may open third-party websites or applications. Links can change, become unavailable, require additional information, or produce different results. Your use of a third-party service is governed by its own terms and privacy policy. Review all information before submitting it.
6. Baggage numbers and PIR references
A baggage-tag number and a Property Irregularity Report (“PIR”) or claim reference are different identifiers. Some airline recovery services require a PIR issued only after a report is filed. Baggage Trace may store both but does not issue or validate either identifier.
7. Purchases and subscriptions
Paid features may be offered through auto-renewable subscriptions or non-consumable purchases processed by Apple. The App Store purchase screen displays the applicable price, billing period, trial, and terms before confirmation.
- Payment is charged to your Apple Account at confirmation of purchase.
- An auto-renewable subscription renews unless cancelled at least 24 hours before the end of the current period.
- Your Apple Account may be charged for renewal within 24 hours before the current period ends.
- You can manage or cancel subscriptions in your Apple Account settings.
- Trials, refunds, billing, and family sharing are subject to Apple’s rules and the offer shown in the App Store.
Features, pricing, and available purchase options may vary by country and may change for future purchases. Mandatory consumer rights remain unaffected.
8. Acceptable use
You may not misuse the Service, attempt unauthorised access, interfere with its operation, reverse engineer it except where law expressly permits, submit unlawful or fraudulent claims, infringe another person’s rights, or use the Service to distribute malicious content.
9. Intellectual property
The Service, including its software, design, branding, and original content, is owned by or licensed to Baggage Trace and protected by applicable intellectual-property laws. These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose.
10. Your content
You retain ownership of information and photographs you add. You confirm that you have the right to use them. The app processes this content as necessary to provide features you request, including local organisation, label recognition, and user-initiated sharing.
11. Availability and changes
We may maintain, modify, add, remove, suspend, or discontinue features. We aim to keep airline links useful but do not promise continuous availability or coverage of every airline, country, claim type, or device. Updates may be required for continued operation.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement. We do not warrant that recognition results, airline links, or third-party information will be complete, accurate, or current.
13. Limitation of liability
To the maximum extent permitted by law, Baggage Trace will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of baggage, travel, data, revenue, opportunity, or claims arising from reliance on the Service or a third-party service. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded.
14. Indemnity
Where permitted by law, you agree to indemnify Baggage Trace against third-party claims resulting from your unlawful misuse of the Service, fraudulent submissions, or violation of another person’s rights.
15. Termination
You may stop using the Service at any time. We may restrict access when reasonably necessary to protect the Service, users, third parties, or comply with law. Provisions that by their nature should survive termination will continue to apply.
16. Governing rules
These Terms are governed by the laws applicable where the operator is established, without removing any mandatory protections you receive under the law of your habitual residence. Disputes will be handled by competent courts, subject to mandatory consumer-jurisdiction rules.
17. Apple-specific terms
If you downloaded the app from Apple’s App Store, Apple is not responsible for the Service or its support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable provisions. Apple’s Standard Licensed Application End User License Agreement also applies where required.
18. Changes to these Terms
We may update these Terms to reflect changes to the Service or law. Revised Terms will be published here with a new effective date. If a material change requires consent, we will request it as required by law.
